Terms and Conditions

1. Bookings and Payments

  • All sessions and services must be booked in advance and paid for at the time of booking, unless an ongoing payment arrangement (such as direct debit for semi-private sessions) has been established.
  • Payments are accepted via the methods provided on the website, including credit card, bank transfer, or Stripe.
  • The client is responsible for ensuring their contact and payment details are accurate and up to date.

2. Membership and Session Packages

  • Clients may purchase individual sessions, session packages, or memberships. All package sessions must be used within the timeframe specified at the time of purchase (e.g., 12 weeks from the date of purchase). Unused sessions will not carry over beyond the expiry date.
  • Memberships entitle clients to a specified number of sessions per month. Unused sessions within a membership period do not roll over to the following month.
  • Session packages and memberships are non-transferable and non-refundable unless otherwise stated in writing.

3. Cancellations and Refunds

  • 48-Hour Notice: Cancellations made more than 48 hours before the scheduled session will be fully refunded.
  • Less than 48-Hour Notice: Cancellations made with less than 48 hours’ notice will allow for a reschedule but no refund will be given.
  • No Shows: Failure to attend a scheduled session without notice will result in the loss of the session fee, and no refund or rescheduling will be provided.
  • All rescheduled sessions are final, and further rescheduling may incur an additional fee.

4. Late Arrivals

  • If a client arrives late for a session, the session will still end at the scheduled time, and the full session fee will apply.
  • If the coach is late for a session, additional time will be added to the session or rescheduled based on the client’s availability.

5. Ongoing Direct Debit for Semi-Private Sessions

  • For clients attending semi-private sessions, payments will be processed via direct debit on an ongoing basis.
  • Requests to cancel direct debit arrangements must be made in writing or directly via Stripe. Cancellations will take effect after the current billing cycle. No refunds will be issued for any remaining sessions in the current cycle.

6. Health and Safety

  • Clients are responsible for disclosing any relevant medical conditions, injuries, or physical limitations prior to starting training. Failure to do so may result in cancellation of services without refund.
  • Clients are advised to consult a healthcare professional before engaging in any physical fitness programs. By participating, clients certify they are in good health and capable of performing physical activity.
  • The coach reserves the right to refuse service or terminate sessions if they feel a client’s health and safety is at risk.

7. Assumption of Risk and Liability Waiver

  • Participation in any strength and conditioning sessions involves inherent risks, including but not limited to injuries, strains, or medical conditions.
  • By booking and participating in sessions, clients voluntarily assume all risks and waive any claim against the coach for injuries, losses, or damages incurred.
  • The coach shall not be held liable for any injuries sustained during the course of training, whether during in-person or online sessions.

8. Use of Equipment and Facilities

  • Clients are responsible for the proper use of all gym equipment and facilities. Any damage caused by improper use may result in the client being charged for repair or replacement.
  • Clients must follow the coach’s instructions regarding safety and equipment use at all times.

9. Code of Conduct

  • Clients are expected to conduct themselves respectfully at all times. Disruptive behavior, verbal abuse, or harassment towards staff or other clients will not be tolerated and may result in immediate termination of services without refund.
  • The coach reserves the right to terminate any membership or session package at their discretion if a client violates this code of conduct.

10. Confidentiality

  • The coach respects client confidentiality. Personal information shared during consultations or training sessions will not be disclosed to third parties without prior consent, except where required by law.
  • Clients must also respect the confidentiality of the coach and other clients. Filming or taking photos during sessions without consent is strictly prohibited.

11. Modification of Services

  • The coach reserves the right to modify or discontinue services, training programs, or pricing at any time. Clients will be notified of significant changes in advance.
  • In the event of the coach needing to cancel or reschedule a session, clients will be offered an alternative session or a full refund.

12. Governing Law

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Western Australia. Any disputes arising from these terms will be resolved under the jurisdiction of Western Australia.
